BC Property Disclosure Statement (PDS)

The PDS is a standardized form covering the seller's knowledge of the property's condition. Complete it honestly — BC courts have held sellers liable for known defects not disclosed on the PDS.

PDS sections

  • Structural: foundation, roof, walls, attic, basement
  • Mechanical: heating system, plumbing, electrical, water heater
  • Environmental: oil tanks (common in Metro Vancouver), asbestos, lead paint, mold, site contamination
  • Water/drainage: flooding history, drainage issues
  • Legal: strata/HOA, easements, encroachments, permits
  • Title: charges, covenants, rights of way

    Many Metro Vancouver homes built before 1970 have decommissioned underground oil tanks. If yours has a tank (decommissioned or active), disclose it. Buyers will order an oil tank scan ($150–$300) during inspection. Undecommissioned tanks are a liability — decommission before listing if discovered.

    Latent vs. Patent Defects

    BC law: sellers must disclose known latent defects (hidden, not discoverable on reasonable inspection). Patent defects (visible, observable) are buyer's responsibility. When in doubt, disclose — it protects you and builds buyer confidence.

    Strata (Condo) Disclosure

    Strata property sellers must provide the strata's financial statements, minutes (last 2 years), bylaws, depreciation report, Form B (strata certificate), and special levy disclosures. Vancouver condo buyers expect full strata document packages. Assemble these early — it takes time.
