San Francisco Home Seller Disclosure Requirements (2026)

Statewide California Requirements (Apply to SF)

All SF sellers must complete the standard California disclosures:

  • Transfer Disclosure Statement (TDS) — Civil Code §1102
  • Natural Hazard Disclosure — fire, flood, earthquake zones
  • Lead paint disclosure — pre-1978 homes
  • Smoke/CO detector compliance
  • San Francisco-Specific Disclosures

    Residential Building Record (3R Report)

    Order from SF Department of Building Inspection (DBI) for approximately $150. The 3R Report shows permit history, legal use, and any open violations. Buyers almost always request this — order it before listing.

    SF Seller's Supplemental Checklist

    SF requires an additional checklist covering:
  • Unpermitted additions or alterations
  • Water intrusion or drainage issues
  • Pest and fungus inspection results
  • Neighborhood-specific issues (flight paths, transit noise)
  • Rent Ordinance Disclosure

    SF's rent control ordinance is extensive. If any unit was tenant-occupied, you must disclose:
  • Whether units are rent-controlled
  • Current or recent tenancies
  • Any owner move-in evictions in the past 10 years (affects resale under SF law)
  • Seismic / Soft-Story Retrofit

    SF requires soft-story wood-frame buildings (typically 3+ units, 2+ stories) to complete mandatory seismic retrofitting. Disclose compliance status and any pending work.

    Transfer Tax

    SF's transfer tax is tiered:
  • $250K–$1M: 0.675%
  • $1M–$5M: 0.725%
  • $5M–$10M: 2.25%
  • $10M–$25M: 2.75%
  • $25M+: 3%
  • On a $1,400,000 sale, the transfer tax is approximately $10,150.

    Pest Inspection

    While not legally mandated, SF custom requires sellers to provide a pest (Section 1) inspection report. Expect to pay $150–$250.
