San Antonio Home Seller Disclosure Requirements (2026)

Texas Seller's Disclosure of Property Condition (TREC OP-H)

Texas Property Code §5.008 requires sellers to complete a Seller's Disclosure of Property Condition (TREC Form OP-H) for most 1–4 unit residential sales. Provide to buyers before or at contract execution.

The form covers:

  • Structural components (foundation, roof, walls, floors)
  • Systems (plumbing, electrical, HVAC, water heater)
  • Appliances included in the sale
  • Environmental hazards (lead, asbestos, radon, underground tanks)
  • Flood zone status and prior flooding
  • Legal matters (HOA, easements, zoning)
  • Insurance claims history (important for Texas wind/hail claims)
  • Flood Zone in San Antonio

    Parts of San Antonio (particularly along the San Antonio River and Salado Creek) are in FEMA flood zones. Disclose flood zone status if applicable. The City of San Antonio has invested heavily in flood mitigation, but some areas remain at risk.

    Insurance Claims — Texas Hail and Wind

    Texas sellers must disclose prior insurance claims. Hail damage is extremely common in San Antonio — roof insurance claims trigger scrutiny in subsequent sales. Disclose any known claims and document repairs.

    Lead Paint

    Required for pre-1978 homes.

    No Texas Transfer Tax

    Texas has no real estate transfer tax. This is a significant seller advantage.
