Arizona Seller Disclosure Requirements 2026 — SPDS and Pool Barrier Guide

Published March 14, 2026

Arizona's SPDS is comprehensive — 8 categories covering nearly every material aspect of your property.

The SPDS Categories

Utilities, sewer/water, structural/mechanical systems, environmental hazards (radon, asbestos, mold, underground tanks), legal issues (HOA violations, encroachments, litigation), insurance claims history, pool/spa details, and neighborhood conditions.

Swimming Pool Barrier — Don't Miss This

If your property has a pool, spa, or decorative pond, you must provide a pool safety disclosure per Arizona Revised Statute 36-1681. This covers fence height, gate latch requirements, and door alarms. Most Phoenix metro homes with pools need this completed.

HOA Disclosure Package

Phoenix-area master-planned communities universally have HOAs. The required package includes CC&Rs, bylaws, financials, and pending assessments. Request it immediately — it takes 5–10 business days and costs $200–$400.

Affidavit of Property Value

Required at closing for all Arizona sales. Documents the sale price for the Maricopa County Assessor. Your title company files this automatically.
