Tennessee Residential Property Condition Disclosure

Tennessee Code §66-5-202 requires sellers to complete a Residential Property Condition Disclosure form and provide it to buyers before or at the time of contract execution.

The form covers:

  • Roof, foundation, structural components
  • Plumbing, electrical, HVAC, water heater
  • Water source (public or well) and sewage type
  • Basement and crawlspace moisture issues
  • Environmental hazards (lead, asbestos, radon, underground tanks)
  • Flood zone status
  • Legal matters (easements, zoning, liens, HOA)
  • Radon in Tennessee

    Knox County has moderate radon potential. Disclose any known test results; buyers frequently include radon testing as an inspection contingency.

    Lead Paint

    Required for pre-1978 homes.

    Tennessee Realty Transfer Tax

    $0.37 per $100 of consideration. On a $330,000 Knoxville sale: $1,221. Knox County charges a local privilege tax — confirm current rates with your title company.

    No Attorney Requirement

    Tennessee does not require an attorney for residential closings. Title companies handle escrow in Knoxville.
