Detroit Home Seller Disclosure Requirements (2026)

Michigan Seller's Disclosure Statement

Michigan Compiled Laws §565.951 through §565.965 require sellers to complete a Seller's Disclosure Statement and provide it before or upon offer acceptance. Buyers have a 72-hour right of rescission.

The form covers:

  • Structural components (foundation, roof, walls, floors)
  • Systems (plumbing, electrical, HVAC, water heater)
  • Water source and sewage type
  • Basement and crawlspace moisture
  • Environmental hazards (lead, asbestos, radon, underground tanks)
  • Flood zone status
  • Legal matters (easements, zoning, liens, HOA)
  • Lead Paint — Metro Detroit

    Metro Detroit has extensive pre-1978 housing stock. Federal lead paint disclosure is required. The City of Detroit has strict lead paint ordinances for rental properties. For sales, comply with federal requirements.

    Radon

    Southeast Michigan has moderate radon potential. Disclose any known test results. Buyers in newer suburban construction (particularly with basements) often request radon testing.

    Michigan Transfer Tax

    Higher than most states:

  • State: $3.75 per $500 of sale price
  • County: $0.55 per $500 of sale price
  • Combined: $4.30 per $500 ($8.60 per $1,000)
  • On a $340,000 sale: $2,924.

    First-time buyer exemption: Michigan law exempts first-time buyers from the county transfer tax — confirm with your title company.

    No Attorney Requirement

    Michigan does not require an attorney for residential closings. Title companies handle escrow.
