Ohio Residential Property Disclosure Form

Ohio Revised Code §5302.30 requires sellers to complete a Residential Property Disclosure Form and provide it to buyers before or upon offer. Buyers have 3 business days after receipt to rescind.

The form covers:

  • Water intrusion (basement, crawlspace)
  • Structural components (roof, foundation, walls, floors)
  • Systems (plumbing, electrical, HVAC, water heater)
  • Environmental hazards (lead, radon, asbestos, underground tanks)
  • Flood zone status
  • Legal matters (zoning, easements, liens, HOA)
  • Radon — Important in Dayton

    The Miami Valley region has elevated radon potential. Ohio has one of the higher radon rates in the Midwest. Disclose any known test results. Buyers routinely include radon contingencies.

    Lead Paint

    Required for pre-1978 homes.

    Ohio Conveyance Fee (Transfer Tax)

    Montgomery County charges a combined conveyance fee:

  • State: $1 per $1,000
  • County: $3 per $1,000 (Montgomery County uses maximum)
  • Total: $4 per $1,000 ($4.30 per $1,000 with rounding in some calculations)
  • On a $245,000 Dayton sale: approximately $980.

    No Attorney Requirement

    Ohio does not require an attorney for residential closings.

    Older Housing Stock

    Dayton has significant older housing stock (pre-1960s). Common issues in these homes include: knob-and-tube or aluminum wiring, galvanized plumbing, asbestos insulation or floor tiles, and foundation cracking. Disclose any known issues.
