Connecticut FSBO Disclosure Requirements (2026)

Connecticut Disclosure Law

Connecticut General Statutes §20-327b requires sellers to provide a Property Condition Disclosure Report to buyers before or at the time of signing a purchase agreement.

What Must Be Disclosed

  • Roof age and condition
  • Basement water or moisture issues
  • Foundation or structural defects
  • Heating, plumbing, and electrical systems
  • Well and septic condition (if applicable)
  • Underground oil storage tanks
  • Radon test results (if available)
  • Lead paint (pre-1978 homes — federal requirement)
  • Any pending litigation or encumbrances
  • Underground Oil Tanks

    Connecticut has strict regulations on underground oil storage tanks. Sellers must disclose any known tanks, whether active or decommissioned. Buyers often require a tank sweep as a condition of sale.

    Radon

    Connecticut has elevated radon levels in many areas. While not legally required to test, sellers who have tested must disclose results. Buyers commonly add a radon contingency.

    Exemptions

    New construction by a builder, foreclosure sales, and transfers by court order are exempt.

    Penalties

    Failure to disclose known material defects exposes sellers to rescission claims and damages under CGS §20-327b. Connecticut courts have allowed buyers to recover attorney fees in proven concealment cases.
