Columbus Home Seller Disclosure Requirements (2026)

Ohio Residential Property Disclosure Form

Ohio Revised Code §5302.30 requires sellers to complete a Residential Property Disclosure Form and provide it to buyers before or upon offer. Buyers may rescind within 3 business days of receipt.

The form covers:

  • Water intrusion (basement, crawlspace, foundation)
  • Roof condition and age
  • Structural components (walls, floors, ceilings)
  • Plumbing, electrical, HVAC systems
  • Lead paint, radon, asbestos, underground storage tanks
  • Flood plain status
  • Zoning violations and boundary disputes
  • HOA fees and rules
  • Radon in Ohio

    Ohio has significant radon risk — the Ohio Department of Health estimates that approximately one in four Ohio homes has elevated radon levels. Disclose any known radon test results. Buyers increasingly require radon testing as a contingency.

    Lead Paint

    Required for pre-1978 homes.

    Ohio Conveyance Fee (Transfer Tax)

    Counties charge a conveyance fee:

  • State portion: $1 per $1,000 of sale price
  • County portion: varies (Franklin County: $2/$1,000 total including state; some counties vary)
  • On a $320,000 sale in Franklin County: approximately $640.

    HOA in Columbus Suburbs

    New Columbus-area developments (Dublin, Westerville, New Albany, Grove City) commonly have HOAs. Provide CC&Rs, bylaws, financials, and disclosure of pending special assessments.

    No Attorney Requirement

    Ohio does not require an attorney for residential closings. A title company handles escrow, title search, and deed recording. Consider a title company attorney review ($300–$500) for complex contracts.
