Massachusetts Lead Paint Law

Massachusetts has among the strictest lead paint laws in the nation. For homes built before 1978:

  • Federal EPA disclosure is required for all buyers
  • If a child under 6 will occupy the home, Massachusetts law requires the seller to remediate or deleaded the property — not just disclose
  • A licensed MA lead inspector must certify compliance
  • This doesn't kill FSBO deals — but get a lead inspection early so you know your position. Many older Worcester-area homes have lead paint. Budget $1,500–$10,000 for delead if needed.

    Title V (Septic)

    If your home has a private septic system, Massachusetts Title V requires a septic inspection within 2 years of sale. If the system fails, it must be repaired or replaced before closing (or funds escrowed). Get the inspection done before listing — surprises at closing derail deals.

    Smoke and CO Detectors

    Your local fire department must inspect and issue a certificate for smoke and CO detectors before closing. Schedule early — some departments have 2–3 week waits. Cost is typically $50–$150.

    Attorney Requirement

    Massachusetts requires a licensed real estate attorney at closing. Your attorney handles the deed, title search, and closing documents.
