Wisconsin Property Disclosure

Wisconsin law requires sellers to complete the Real Property Disclosure Report (RETR) before the buyer makes an offer or immediately after. It covers:

  • Known defects in the structure, roof, plumbing, electrical, and HVAC
  • Environmental hazards (radon, lead paint, asbestos, underground storage tanks)
  • Legal issues: easements, encroachments, zoning violations, pending assessments
  • Flood zone status and flood history
  • Real Estate Transfer Return

    Wisconsin's Real Estate Transfer Return (RETR) must be filed electronically with the state at closing. The transfer tax is $3 per $1,000 of value — on a $300K sale, that's $900. The county records the deed and the state collects the return.

    What to Disclose

    Wisconsin follows a "disclose what you know" standard. If you're aware of a material defect — a leaky roof, a wet basement, or a cracked foundation — you must disclose it. Failing to disclose can result in post-closing claims and lawsuits.
