Washington DC Home Seller Disclosure Requirements (2026)

DC Seller Disclosure Statement

DC Code §42-1302 requires sellers of residential property to complete the DC Residential Real Property Disclosure Statement. This covers the property's physical condition, systems (HVAC, plumbing, electrical), environmental hazards, and legal issues.

The form is provided to buyers before contract execution. Sellers who knowingly provide false information face civil liability.

Lead Paint Disclosure

For pre-1978 homes (a large portion of DC's rowhouse stock), federal law requires written lead paint disclosure and the EPA pamphlet. DC also has local lead paint regulations — properties with deteriorating paint may trigger DC's lead paint abatement requirements.

Flood and Environmental Disclosures

DC sellers must disclose if the property is in a flood zone. Check FEMA's Flood Map Service Center. Properties near the Anacostia or Potomac may be in flood-prone areas.

Transfer and Recordation Taxes

DC has both a transfer tax and a recordation tax:

  • Transfer tax: 1.1% of sale price (for sales $400K+); 1.45% for sales above $400K (the higher rate applies to the full amount once crossed)
  • Recordation tax: Same rates as transfer tax, paid by buyer
  • By custom, seller and buyer each pay one tax — but this is negotiable
  • On a $700,000 sale, the seller's transfer tax is approximately $10,150.
