Tucson Home Seller Disclosure Requirements (2026)

Arizona Seller's Property Disclosure Statement (SPDS)

Arizona Revised Statutes §33-422 requires sellers to complete a Seller's Property Disclosure Statement (SPDS) for residential sales. The AAR (Arizona Association of Realtors) form is the standard. Provide it to buyers before or upon contract execution.

The SPDS covers:

  • Structural components (roof, foundation, walls)
  • Systems (plumbing, electrical, HVAC, water heater)
  • Water source (municipal, well) and sewage type (sewer, septic)
  • Environmental hazards (lead, asbestos, radon, underground tanks)
  • Insurance claims history
  • HOA information
  • Flood zone status
  • Well and Septic Disclosure

    Tucson has many properties on private wells and septic systems. Disclose water source, well depth, GPM, and septic system type and age. ADEQ (Arizona Dept. of Environmental Quality) maintains septic records.

    Lead Paint

    Required for pre-1978 homes.

    No Real Estate Transfer Tax

    Arizona has no statewide real estate transfer tax and no county transfer tax. This is one of Arizona's significant cost advantages for sellers.

    Flood Zone

    Southern Arizona has significant flash flood activity. Parts of Tucson are in FEMA Special Flood Hazard Areas (near the Santa Cruz River and Rillito). Disclose flood zone status.

    HOA

    Many Tucson master-planned communities have HOAs. Under Arizona law, HOAs must provide a resale disclosure package within 10 days of request. Budget $200–$400 for the package.
