South Carolina Disclosure Law
SC Code §27-50-40 requires sellers to provide a Residential Property Condition Disclosure Statement to buyers before or at the time of signing a purchase agreement.
What Must Be Disclosed
Termites
South Carolina has very high termite activity. WDO inspections are required by FHA and VA lenders and are standard in conventional loans. Sellers who have had termite treatment must disclose it. A current termite bond (warranty) can be a selling point.
Flood Zones
Coastal and low-lying SC properties face significant flood risk. FEMA flood zone status is a material fact that must be disclosed. Buyers in Special Flood Hazard Areas (SFHA) must obtain flood insurance — budget $1,500–$4,000/year.
Exemptions
New construction by a builder, foreclosure sales, estate transfers, and court-ordered sales are exempt from SC's disclosure requirement.
Penalties
Failure to disclose known material defects entitles the buyer to rescind the sale before closing. Post-closing, buyers may pursue fraud damages under SC common law.
