Georgia Seller Disclosure
Georgia requires sellers to complete the Seller's Property Disclosure Statement for all residential sales. The form covers known material defects in the property's structure, systems, and environmental conditions.
Key disclosures
No Attorney Mandate
Georgia does not require an attorney at closing. Title companies handle most residential closings. However, an attorney review of the purchase contract protects your interests — especially for higher-value or complex transactions.
Georgia Transfer Tax
Georgia charges a real estate transfer tax of $1 per $1,000 of consideration (0.1%). On a $350,000 sale, that's $350 — one of the lowest transfer taxes in the nation.
Earnest Money
Georgia purchase contracts typically require earnest money (1–2% of purchase price). As FSBO seller, specify earnest money requirements in your listing or counter-offer. Hold in escrow with the closing attorney or title company.
