California Statewide Disclosures
All San Diego sellers must complete:
Transfer Disclosure Statement (TDS): Civil Code §1102 requires disclosure of known material defects, HOA information, and neighborhood issues for all 1–4 unit residential sales.
Natural Hazard Disclosure: San Diego County has significant hazard zones:
Order an NHD report from a licensed provider. Fire zone disclosure is particularly important in San Diego — buyers in high-risk areas face elevated insurance costs.
Mello-Roos and HOA
Many San Diego planned communities have Mello-Roos special taxes. Disclose the annual amount. For HOAs, provide the full resale disclosure package (CC&Rs, financials, rules, pending assessments).
Lead Paint (Pre-1978)
Federal disclosure required: written notice, EPA pamphlet, 10-day inspection period.
San Diego County Transfer Tax
$1.10 per $1,000 of sale price. On a $950,000 sale: approximately $1,045. Paid by seller unless negotiated otherwise.
Water Heater and Seismic
Sellers must certify that the water heater is braced (seismic safety). Low-flow fixtures and smoke/CO detectors also required at transfer.
Military/VA Considerations
San Diego's market includes many VA loan buyers. The VA's Minimum Property Requirements (MPRs) can require repairs before closing — a pre-listing inspection helps identify these in advance.
