Utah Seller Property Condition Disclosure
Utah Code §57-27-101 et seq. requires sellers of residential property to complete a Seller Property Condition Disclosure and deliver it to buyers before or upon offer acceptance. Buyers have 3 business days after receipt to review.

Radon in Utah
Utah has moderate-to-high radon potential in many areas. If you have a radon test result, disclose it. The EPA recommends mitigation above 4 pCi/L. Radon testing is inexpensive ($15–$30 DIY kit) and buyers increasingly request it.
Lead Paint
Required for pre-1978 homes. Written disclosure, EPA pamphlet, and 10-day inspection period.
HOA Disclosure
If the property is in an HOA, Utah Code §57-8a requires delivery of a resale disclosure certificate covering: annual fees, reserves, pending assessments, litigation, and CC&Rs. The HOA must provide this within 10 days of request ($200–$400 fee is common).
No Transfer Tax
Utah has no statewide real estate transfer tax. This is a significant benefit compared to states like California, NY, or DC.
Water Rights
In rural or semi-rural Utah areas, water rights can be a separate property interest. Disclose any water shares, irrigation company shares, or shares in a canal company associated with the property.
