Sacramento Home Seller Disclosure Requirements (2026)

California Statewide Disclosures

Sacramento sellers must complete California's standard residential disclosure package:

Transfer Disclosure Statement (TDS): Civil Code §1102. Required for all 1–4 unit sales. Covers physical condition, systems, legal issues, and HOA data.

Natural Hazard Disclosure: Sacramento's notable hazard zones include:

  • FEMA Flood Zones: Large portions of the Sacramento metro (especially West Sacramento, Natomas, Pocket area) have been in SFHA zones. Post-levee improvements changed some classifications — verify current status.
  • Fire Hazard Severity Zones: Eastern suburbs (Folsom, El Dorado Hills) border Very High Fire Hazard areas.
  • Seismic: Alquist-Priolo fault zones exist in the Sierra foothill areas.
  • Lead Paint

    Required for pre-1978 homes. Written disclosure, EPA pamphlet, and 10-day inspection period.

    Mello-Roos and HOA

    Widespread in Sacramento's newer suburbs. Elk Grove, Natomas, Lincoln, and Roseville developments commonly have Mello-Roos districts. Disclose annual amounts and provide HOA resale packages where applicable.

    Sacramento County Transfer Tax

    $1.10 per $1,000 of sale price. No additional city transfer tax for most Sacramento areas (unlike SF or SJ).

    Smoke and CO Detectors / Water Heater Bracing

    Required at transfer. Seller signs a compliance statement in the purchase agreement.

    Seller Physical Inspection (SPI)

    While not legally required, Sacramento custom includes providing a pest (Section 1) inspection. Buyers commonly request it — doing it pre-listing saves renegotiation time.
