Richmond Home Seller Disclosure Requirements (2026)

Published October 2, 2025

Virginia Residential Property Disclosure Statement

Virginia Code §55.1-703 requires sellers to provide a Residential Property Disclosure Statement to buyers. As with other Virginia jurisdictions, the mandated form is primarily a notice of buyer inspection rights rather than a detailed condition disclosure.

Best practice: Provide a supplemental Seller's Disclosure of Existing Conditions disclosing any known material defects. This protects sellers from post-closing fraud claims.

Common Richmond Disclosure Issues

Richmond's older housing stock (Fan District, Church Hill, Oregon Hill) commonly involves:

  • Knob-and-tube or aluminum wiring in pre-1950 homes
  • Cast iron or galvanized plumbing in older homes
  • Foundation issues — Richmond sits on varied geology (some areas have expansive clay soils)
  • Oil tanks — fuel oil heating was common; disclose any known above/below-ground oil tanks
  • Lead Paint

Required for pre-1978 homes. Significant in Richmond's older urban neighborhoods.

    Virginia Grantor Tax

    $0.25 per $100 of consideration. On a $370,000 sale: $925.

    Henrico/Chesterfield County Differences

Both Henrico and Chesterfield county impose local recordation taxes in addition to the state grantor tax. Confirm total recording fees with your title company.

    HOA Disclosures

Virginia Code §55.1-1808 governs HOA disclosures. Sellers must provide buyers with the HOA disclosure packet, including fees, rules, financials, and pending assessments. Request the packet from the HOA early — it can take up to 14 days.
