Rhode Island Disclosure Law
RIGL §5-20.8-2 requires sellers to provide a written Property Condition Disclosure Statement to buyers before or at signing of the purchase agreement.
What Must Be Disclosed
Lead Paint
Rhode Island has one of the highest concentrations of pre-1978 housing in the US. Sellers of pre-1978 homes must comply with both federal EPA lead paint disclosure rules and Rhode Island's Lead Hazard Mitigation Act (RIGL §42-128.1). RI buyers have special rights to receive lead inspection reports before sale.
Exemptions
New construction, foreclosure sales, estate transfers, and court-ordered sales are exempt from the RI disclosure requirement.
Penalties
Failure to provide the disclosure statement or concealment of a material defect entitles the buyer to rescind the sale and recover damages including attorney fees.
