Portland Home Seller Disclosure Requirements (2026)

Oregon Seller's Property Disclosure Statement

ORS 105.465 requires sellers of residential property to complete a Seller's Property Disclosure Statement. The form must be delivered to the buyer before or within 5 days of accepting an offer. Buyers have 5 business days to review and may rescind the contract after receiving it.

The form covers:

  • Structural components (foundation, roof, walls)
  • Systems (electrical, plumbing, heating)
  • Environmental hazards (asbestos, lead, radon, mold)
  • Legal matters (permits, boundary disputes, encroachments)
  • HOA information
  • Oil Tank Disclosure

    Portland has a high prevalence of abandoned underground oil storage tanks (USTs) from older heating systems. If there is an oil tank (above or below ground) on the property — active, decommissioned, or removed — disclose it. Buyers commonly request a tank sweep ($300–$500). An undisclosed UST can create significant liability.

    Lead Paint

    Required for pre-1978 homes. Written disclosure, EPA pamphlet, and 10-day inspection period.

    Radon

    Oregon is a moderate radon state. While disclosure of known radon levels is required, a radon test ($15–$30 DIY) is recommended. If elevated (above 4 pCi/L), disclose and consider mitigation.

    No Transfer Tax

    Oregon and Multnomah County do not impose a real estate transfer tax on residential sales. Some cities have local taxes (Washington County cities vary) — check with your title company.

    Washington State (Clark County Sellers)

    Portland metro extends into Washington State (Vancouver/Clark County). Washington has different disclosure requirements — see the Washington Seller Disclosure Act (RCW 64.06) if selling in WA.
