Oklahoma Residential Property Condition Disclosure

Oklahoma Statute Title 60, §833 requires sellers to complete a Residential Property Condition Disclosure Statement before accepting an offer. Buyers may rescind within 5 days of receipt.

The form covers:

  • Structural elements (foundation, roof, walls)
  • Plumbing, electrical, HVAC systems
  • Water and sewage
  • Environmental hazards (lead, asbestos, underground tanks)
  • Flood zone status
  • Legal matters (zoning, easements, liens)
  • HOA information
  • Mineral Rights in Oklahoma

    Oklahoma has extensive oil and gas activity. Sellers must disclose whether mineral rights are included in the sale or have been severed. A severed mineral estate can affect surface use rights and should be disclosed clearly.

    Lead Paint

    Required for pre-1978 homes.

    Oklahoma Deed Stamp Tax

    Oklahoma charges a deed stamp tax of $0.75 per $500 of sale price (0.15%). On a $270,000 sale: $405. Paid by seller at closing.

    No Attorney Requirement

    Oklahoma does not require an attorney for residential closings. Title companies handle escrow and closing in OKC.

    Flood Zone

    Parts of Oklahoma County are in FEMA flood zones (near the North Canadian River and its tributaries). Disclose flood zone status if known. Buyers in SFHAs must purchase flood insurance if using a federally backed loan.
