Your attorney reviews the purchase contract, negotiates modifications during the 3-day review window, orders the title search, and handles the closing. Budget $1,000–$1,800 for NJ closing attorney fees.

2. Complete Required Disclosures

New Jersey requires the Seller's Property Condition Disclosure Statement covering all known material defects. Additionally, New Jersey requires disclosure of flood zone status and any flood damage history. If your home is in a FEMA-designated flood zone, buyers will need flood insurance — disclose this upfront. Lead Paint Disclosure applies to all pre-1978 homes (federal law).

3. List on MLS via Flat Fee Service

Garden State MLS (northern NJ) and Bright MLS (southern NJ) are the two primary MLSs. A flat fee MLS listing ($95–$399) syndicates your home to Zillow, Realtor.com, Redfin, and all major buyer-facing sites. Offer a buyer's agent commission (typically 2–2.5%) to ensure agents show your home.

4. Navigate the Attorney Review Period

After a purchase contract is signed, New Jersey law gives both parties 3 business days to have their attorney review and modify the contract. This is a unique NJ feature — your attorney can request changes to price, contingencies, closing date, or included items. The buyer's attorney can do the same.
