New Hampshire FSBO Disclosure Requirements (2026)

New Hampshire Disclosure Law

RSA 477:4-c requires sellers of residential property to provide a written Residential Disclosure Report to buyers before or at the time of signing a purchase agreement.

What Must Be Disclosed

  • Roof condition and known leaks
  • Foundation or structural defects
  • Basement or crawl space moisture
  • Heating, plumbing, and electrical systems
  • Well condition and water quality
  • Septic system condition
  • Radon test results (if available)
  • Any known environmental hazards
  • HOA obligations and pending assessments
  • Radon

    New Hampshire has elevated radon levels, particularly in granite-rich areas. Sellers with existing test results must disclose them. Buyers routinely add radon test contingencies.

    Well and Septic

    New Hampshire has widespread private well and septic use. Buyers typically require a Title V–equivalent septic inspection and water quality test. Sellers should obtain these before listing to avoid surprises.

    Exemptions

    New construction by a builder, foreclosure sales, estate transfers, and court-ordered sales are exempt.

    Penalties

    Failure to provide the disclosure or concealment of material defects entitles the buyer to rescind the sale and recover damages including attorney fees.
