Selling FSBO in Minnesota

2. Complete Required Disclosures

Minnesota requires the Seller's Property Disclosure Statement for most sales. Minnesota sellers must also provide the Disclosure of Well, Sewage Treatment System, and Individual Sewage Treatment System if applicable — Minnesota has strict requirements for disclosed well and septic systems. Lead Paint Disclosure required for pre-1978 homes. Minnesota has a deed tax of $3.30 per $1,000 of sale price (rounded up), paid by the buyer — no seller transfer tax.

5. Review Offers and Negotiate

Compare offers by net proceeds, not just purchase price. A clean offer at $5,000 under asking with no contingencies may net more than a higher offer with a lengthy inspection period, financing contingency, and closing cost credits. Respond within 24 hours — slow responses signal inexperience and buyers move on. Counter-offers are normal; don't feel pressure to accept the first offer or the first counter.

6. Close the Sale

Minnesota closings are typically handled by a title company acting as the closing agent. The title company conducts a title search, issues title insurance, holds escrow, and records with the county recorder. The Minnesota deed tax ($3.30/$1,000) is paid by the buyer.
