Kentucky Seller's Disclosure of Property Condition
KRS §324.360 requires sellers to complete a Seller's Disclosure of Property Condition and provide it to buyers before or upon entering contract.
The form covers:
Radon in Kentucky
Kentucky has moderate radon potential. Disclose any known radon test results. The EPA recommends mitigation above 4 pCi/L. Buyers increasingly request radon testing.
Lead Paint
Required for pre-1978 homes.
Kentucky Transfer Tax
Kentucky charges a transfer tax of $0.50 per $500 of consideration (0.1%). On a $290,000 sale: $290. Minimal compared to many states.
No Attorney Requirement
Kentucky does not require an attorney for residential closings. Title companies handle closing in Louisville.
HOA Disclosures
For properties in planned communities, disclose HOA fees, rules, and pending assessments. Provide a copy of the CC&Rs and bylaws upon request.
Seller's Right to Cure
Under Kentucky law, if a seller receives notice of a buyer's intent to rescind based on a disclosure issue, the seller has the right to cure the disclosed condition before the buyer can cancel.
