Arkansas Property Disclosure

Arkansas requires sellers to complete the Residential Property Disclosure Form before or at time of contract. The form covers known defects in structural components, mechanical systems, and environmental conditions.

Form sections

  • Structural: foundation, roof, walls, basement/crawl space
  • Mechanical: heating, cooling, plumbing, electrical, water heater
  • Environmental: lead paint, radon, underground tanks, hazardous materials
  • Water: public/well source, quality issues
  • Legal: HOA, easements, zoning violations
  • "Disclose What You Know"

    Arkansas does not require sellers to investigate defects they don't know about. But if you know about a material problem — a cracked foundation, past flooding, active termite damage — you must disclose it. Concealing known defects exposes you to fraud claims and post-closing litigation.

    No Attorney Requirement

    Arkansas does not require an attorney at closing. Title companies handle most closings. However, consulting an attorney to review your purchase agreement is always a good idea.
