Kansas City Home Seller Disclosure Requirements (2026)

Missouri Seller's Disclosure Statement (DSC-8000)

Missouri Statute §339.730 requires sellers to complete a Missouri Seller's Disclosure Statement (Form DSC-8000). Provide it to buyers before or at the time of contract. Buyers have 3 business days to rescind after receipt.

The form covers:

  • Structural components (foundation, roof, walls, floors)
  • Systems (plumbing, electrical, HVAC)
  • Water source and sewage type
  • Basement moisture and drainage
  • Environmental hazards (lead, asbestos, radon, underground tanks)
  • Flood zone status
  • Legal matters (easements, zoning, liens, HOA)
  • Radon in Missouri

    Missouri has significant radon risk. Jackson County and surrounding counties have elevated potential. Disclose known test results. Buyers routinely include radon testing as an inspection contingency.

    Lead Paint

    Required for pre-1978 homes.

    No Missouri Transfer Tax

    Missouri does not impose a real estate transfer tax. This is a significant advantage for sellers.

    Kansas Properties (Johnson/Wyandotte Counties)

    If your property is on the Kansas side of KC (Overland Park, Shawnee, Lenexa, etc.), Kansas law applies:

  • Kansas does not have a mandatory disclosure statute — but common law requires disclosure of known material defects
  • Kansas does have a transfer tax ($1.30/$1,000 on the first $100K; $1.80/$1,000 above)
