Florida Seller Disclosure Requirements
Florida does not have a single mandatory disclosure form by statute (unlike California or Ohio), but sellers are legally required under common law (Johnson v. Davis, 480 So.2d 625) to disclose all known material facts that materially affect the value of the property and are not readily observable.
The standard Florida Seller's Disclosure form covers:
Flood Zone — Important in Jacksonville
Duval County has extensive FEMA flood zones along the St. Johns River and its tributaries. Disclose if the property is in a Special Flood Hazard Area (SFHA). Flood insurance in SFHAs is required for federally backed loans and can add $1,500–$4,000/year to ownership costs.
Lead Paint
Required for pre-1978 homes.
Florida Documentary Stamp Tax
$0.70 per $100 of sale price. On a $360,000 Jacksonville sale: $2,520. Paid by seller. Note: Duval County (Jacksonville) and Miami-Dade County have slightly different rates — Duval uses the $0.70 rate.
Homestead Exemption
Homestead-exempt properties have a Save Our Homes assessment cap. When sold, the cap resets — buyers must apply for their own homestead exemption by March 1 following purchase.
