Jackson MS FSBO: Flood Disclosure and Property Condition Requirements (2026)

Published January 15, 2026

Mississippi Seller Disclosure

Mississippi sellers complete the Seller's Disclosure Statement covering all known property defects. The form is required before or at offer acceptance.

What to disclose

  • Structural: foundation, roof, walls, floors
  • Mechanical: HVAC, plumbing, electrical
  • Water intrusion: flooding history, drainage issues, sump pump presence
  • Environmental: lead paint, underground tanks, hazardous materials
  • Legal: HOA fees, easements, pending assessments
  • Flood Disclosure is Critical in Jackson

Jackson has experienced significant flooding events. Mississippi's disclosure form requires you to disclose: whether the property has ever flooded, whether it's in a FEMA flood zone, and whether flood insurance is or has been required. Do not omit this — it's one of the most litigated post-closing issues in Mississippi.

    FEMA Flood Zone

Check FEMA's flood map (msc.fema.gov) for your address before listing. If your property is in a Special Flood Hazard Area (SFHA), disclose it prominently in the listing. Buyers using conventional or FHA/VA loans will be required to purchase flood insurance.

    No Attorney Requirement

Mississippi does not require an attorney at closing. Title companies handle most closings. An attorney review of the purchase contract is optional but recommended for complex transactions.
