Indianapolis Home Seller Disclosure Requirements (2026)

Indiana Residential Real Estate Sales Disclosure (Form 46234)

Indiana Code §32-21-5 requires sellers to complete the Indiana Residential Real Estate Sales Disclosure Form (Form 46234) and provide it to buyers before or at contract execution. Buyers have 2 business days to rescind after receipt.

The form covers:

  • Structural components (roof, foundation, walls, floors)
  • Systems (plumbing, electrical, HVAC, water heater)
  • Water source (public or well) and sewage type
  • Basement and crawlspace moisture
  • Environmental hazards (lead, asbestos, radon, underground tanks)
  • Flood zone status
  • Legal matters (easements, zoning, liens, HOA)
  • Radon in Indiana

    Indiana has elevated radon potential, particularly in the central and northern parts of the state. Marion County has moderate risk. Disclose known test results; buyers often include radon testing as an inspection contingency.

    Lead Paint

    Required for pre-1978 homes.

    Indiana Transfer Tax

    Indiana charges a conveyance fee of $0.10 per $100 of consideration ($1 per $1,000). On a $310,000 sale: $310. One of the lowest real estate transfer taxes in the country.

    No Attorney Requirement

    Indiana does not require an attorney for residential closings. Title companies handle escrow in Indianapolis.

    Carmel, Fishers, Westfield, and Noblesville have widespread HOA developments. Indiana Code §32-25.5 governs HOA resale disclosures — sellers must provide a disclosure statement from the association.
