Illinois does not legally require an attorney at closing, but every standard Illinois real estate contract includes a 5-business-day attorney review period — and using an attorney is strongly customary in Chicago and the suburbs. Chicago's transfer tax is one of the highest city-level transfer taxes in the country — sellers pay $1.50 per $500, and buyers pay $3.75 per $500, on top of Cook County and Illinois state taxes. Radon disclosure is required statewide, and lead paint disclosure is critical in Chicago where a large percentage of housing stock predates 1978. What Makes Illinois Different for FSBO Sellers

  • Every contract has a 5-day attorney review period. This is built into the standard Illinois Residential Real Estate Purchase and Sale Contract. Do not waive it — use it to have an attorney review all terms, confirm the transfer tax calculation, and check for HOA issues before you are legally bound.
  • Chicago has layered transfer taxes. City of Chicago seller tax: $1.50/$500. Cook County: $0.25/$500. Illinois state: $0.50/$500. On a $355,000 Chicago sale, the seller pays approximately $1,562 in combined transfer taxes. Factor this into your net proceeds.
  • Radon is common in Illinois. The Illinois Radon Awareness Act requires disclosure. Test your home before listing ($15–$30 kit) — finding a high reading before listing lets you install mitigation and present a clean home rather than facing a renegotiation after the buyer's inspection.
  • Older Chicago housing stock means lead paint. Homes built before 1978 require a Lead Paint Disclosure. A large portion of Chicago city homes fall into this category. Have your disclosure ready before listing.

When to List FSBO in Illinois

Spring (late March through June) is the peak window. Chicago winters are harsh enough that the market truly opens later than southern states — late March to April is when buyer activity jumps. May and early June are the most competitive months with the highest likelihood of multiple offers.

Fall (September–October) is a solid secondary window before the holiday slowdown. Winter (December–February) is very slow in Chicago — cold weather and snow significantly reduce showings. If you can wait until spring, it is almost always worth it in Chicago.
