Grand Rapids Home Seller Disclosure Requirements (2026)

Michigan Seller's Disclosure Statement

Michigan Compiled Laws §565.951 through §565.965 require sellers to complete a Seller's Disclosure Statement and provide it to buyers before or upon acceptance of an offer. Buyers have a 72-hour right of rescission after receiving the form.

The form covers:

  • Structural components (foundation, roof, walls, floors)
  • Plumbing, electrical, HVAC, water heater
  • Water source (municipal or well) and sewage type
  • Basement moisture and drainage issues
  • Environmental hazards (lead, asbestos, radon, underground tanks)
  • Flood zone status
  • Legal matters (easements, zoning, liens, HOA)
  • Lead Paint in West Michigan

    Michigan, including the Grand Rapids area, has significant lead paint exposure in pre-1978 housing. Federal disclosure is required. Kent County has local lead hazard programs — buyers in older homes should be encouraged to test.

    Radon

    Michigan has elevated radon potential. Disclose known test results. Buyers routinely request radon testing.

    Michigan Transfer Tax

    Michigan has a combined state and county transfer tax:

  • State: $3.75 per $500 of sale price
  • County: $0.55 per $500 of sale price
  • Combined: $4.30 per $500 ($8.60 per $1,000)
  • On a $350,000 sale: $3,010. Higher than most Midwest states.

    No Attorney Requirement

    Michigan does not require an attorney for residential closings. Title companies handle escrow.

    HOA

    Many suburban Grand Rapids communities (Cascade, Ada, Byron Center) have HOAs. Provide CC&Rs, bylaws, and resale disclosure documents.
