Oregon Seller's Property Disclosure Statement

Oregon's disclosure form is required for all residential sales (1–4 units). Deliver it before or at offer — buyers then have 5 business days to rescind after receipt.

Disclosure sections

  • Structural: foundation, roof, attic, crawl space/basement
  • Systems: HVAC, plumbing, electrical, water heater
  • Environmental: lead paint, radon, asbestos, underground tanks, mold
  • Water: source (public/well/community), quality, irrigation
  • Sewer: public/septic; if septic, last pumped and inspected
  • Land: drainage, flood plain, wetlands, soil stability
  • Legal: HOA, easements, CC&Rs, permits, zoning violations
  • Wetlands in Lane County

    Some Eugene-area properties have wetland designations (Oregon DSL regulated wetlands). If any portion of your lot is designated wetland, disclose it — development restrictions apply and buyers need to know. Check with Lane County DSL or a wetland consultant.

    Radon in Oregon

    Western Oregon has moderate radon levels — lower than the Midwest but not zero. Testing is recommended. Eugene is EPA Zone 2 (moderate potential). Disclose test results if you have them.

    Oregon's No-Transfer-Tax Story

    Oregon has no real estate excise or transfer tax. Compared to Washington's REET (which sellers pay up to 3%), this is a genuine advantage. Market it to Washington buyers considering relocating south on I-5.
