Texas Seller's Disclosure of Property Condition (TREC OP-H)
Texas Property Code §5.008 requires sellers to complete a Seller's Disclosure of Property Condition (TREC Form OP-H) for most 1–4 unit residential sales. It must be provided to buyers before or upon contract execution.

Lead Paint
Required for pre-1978 homes.
Flood Zone — El Paso
While El Paso is generally arid, flash flooding is a real risk. The Rio Grande and arroyos (desert washes) create FEMA flood zone areas. Check the El Paso Central Appraisal District or FEMA Flood Map Service for your property's zone status.
VA Loan Considerations (Fort Bliss)
Fort Bliss is one of the largest military installations in the US. VA loan buyers are common in El Paso. VA appraisals enforce Minimum Property Requirements (MPRs) — ensure your property is in good repair. Peeling paint, exposed wiring, and roof issues must be addressed before a VA appraisal.
No Texas Transfer Tax
Texas has no real estate transfer tax. This is a significant selling advantage.
Seller's Exemptions
Texas law provides certain disclosure exemptions (estate sales, foreclosures, etc.) but most standard FSBO sales require full disclosure.
