Colorado Springs FSBO Disclosure Requirements — The Colorado SPD (2026)

Published January 15, 2026

Colorado Seller's Property Disclosure (SPD)

Colorado's SPD is a comprehensive form required for residential sales. It covers over 100 questions about the property's condition, systems, and legal status. Complete it honestly — Colorado follows a strict "disclose what you know" standard.

SPD sections

  • Structural: foundation, roof, walls, windows, doors
  • Mechanical: HVAC, plumbing, electrical, water heater
  • Environmental: radon, asbestos, lead paint, mold, underground tanks
  • Water/sewer: source, quality, septic status
  • Lot/land: drainage, grading, soil conditions
  • HOA: fees, assessments, restrictions, litigation
  • Legal: easements, encroachments, zoning violations
  • Radon in Colorado Springs

Colorado Springs has elevated radon levels — El Paso County is in EPA Zone 1 (highest risk). Test your home before listing. If radon is above 4 pCi/L, install mitigation ($800–$1,500). Buyers will test — get ahead of it. Disclose test results on the SPD.

    No Attorney Requirement

Colorado uses title companies for closing. Attorneys are optional. The Colorado Real Estate Commission provides standard contracts (CBS form) that both parties should use.

    Colorado Transfer Tax

Colorado has no state-level real estate transfer tax. Some municipalities have local taxes — check your specific city/county.
