Ohio Residential Property Disclosure Form

Ohio Revised Code §5302.30 requires sellers to complete a Residential Property Disclosure Form before or upon offer. Buyers have 3 business days to rescind.

The form covers:

  • Water intrusion and basement issues
  • Structural components (roof, foundation, walls)
  • Systems (plumbing, electrical, HVAC)
  • Environmental hazards (lead, radon, asbestos, underground tanks)
  • Flood zone and drainage issues
  • Legal matters (easements, zoning, liens, HOA)
  • Radon in Cincinnati

    Southwest Ohio has moderate-to-elevated radon potential. Disclose known test results. Hamilton County basements commonly test above 4 pCi/L — buyers frequently include radon contingencies.

    Lead Paint

    Required for pre-1978 homes. Pre-1960 homes in areas like OTR and Westwood commonly have lead paint.

    Hamilton County Conveyance Fee

    $4 per $1,000 combined (state $1 + county $3). On a $310,000 sale: $1,240.

    Kentucky/Indiana Properties (Tristate)

    If your property is in Northern Kentucky (Boone, Kenton, or Campbell County) or southeastern Indiana, different state laws apply:

  • Northern Kentucky: KRS §324.360 Seller's Disclosure
  • Indiana: Must disclose known defects under Indiana law
  • Confirm which state your property is in before preparing disclosures.
