Tennessee Property Condition Disclosure

Tennessee requires the Residential Property Condition Disclosure for all residential sales (3 or fewer units). Deliver to buyer before or at offer acceptance. The form covers all known material defects.

Disclosure form sections

  • Structural: foundation, roof, walls, floor, attic
  • Mechanical: HVAC, plumbing, electrical, water heater
  • Environmental: lead paint, radon, underground tanks, asbestos
  • Water: public or well; quality issues
  • Sewer: public or septic; septic condition
  • Flood: 100-year flood plain status must be explicitly disclosed
  • Tennessee Flood Disclosure

    Tennessee requires sellers to disclose whether the property is located within a 100-year flood plain. Check FEMA's Flood Map Service Center (msc.fema.gov). If in a flood plain, buyers will need flood insurance — disclose this early so it doesn't derail the deal at financing.

    No Attorney Mandate

    Tennessee does not require an attorney at closing. Title companies handle most closings. An attorney review of the purchase contract is optional but useful.

    Tennessee Transfer Tax

    Tennessee charges a real estate transfer tax (documentary stamp tax) of $0.37 per $100 of value. On a $300,000 home, that's $1,110.
