California's Transfer Disclosure Statement (TDS)
The TDS is mandatory for all California residential sales of 1–4 units. You cannot waive it. Complete it fully and accurately — misrepresentation on the TDS is one of the most common causes of real estate litigation in California.
The TDS asks about: structural condition, electrical, plumbing, HVAC, roof, pools, drainage, flooding, encroachments, HOA, neighborhood nuisances, and any additions/alterations. Answer every section.
Natural Hazard Disclosure (NHD)
California law requires disclosure of specific natural hazards. The NHD report is usually ordered from a third-party NHD company (e.g., JCP-LGS, Property ID) for $80–$150. It identifies whether your property is in:

Mello-Roos and Special Assessments
If your property is subject to Mello-Roos Community Facilities District taxes or special assessments, you must disclose this. Buyers should understand these annual costs before closing.
Smoke Detector and Water Heater Compliance
California requires: working smoke detectors (per current code), water heater properly strapped for seismic, and carbon monoxide detectors. Certify compliance on the TDS. Fire department inspections are not required statewide (unlike MA) but some cities require them.
